Job Description:
- Under the close supervision of a Supervising Attorney, the attorney will manage a caseload of clients determined incapacitated by the Superior Court of New Jersey. The attorney will perform a wide range of legal tasks to protect the rights, interests, and assets of these clients, in accordance with statutory requirements, court mandates, and ethical obligations.
Role & Responsibilities:
- Assist in developing and refining OPG policies and procedures related to guardianship proceedings, ensuring compliance with federal and state laws, regulations, and case law.
- Provide legal guidance to OPG care managers, financial managers, and investigators to support the lawful execution of their duties.
- Advocate for OPG clients in administrative hearings involving government entitlements, such as Medicaid and Social Security Disability appeals.
- Assist in representing OPG wards in civil and familial legal actions, including matters involving property sales, divorce, separation, child support, personal injury lawsuits, and other liabilities.
- Participate in the guardianship process by reviewing case referrals, drafting pleadings, preparing court orders, and appearing in Superior Court for guardianship hearings.
- Handle appeals of regulatory decisions, including disputes involving family members, powers of attorney, and other interested parties.
- Assist in defending OPG's fiduciary responsibilities and represent the agency in related legal actions.
- File and defend First and Final Accountings to demonstrate the proper execution of guardianship duties upon case termination.
- Collaborate with the Financial Abuse and Advocacy Specialist Team and the Office of the Attorney General to identify, investigate, and prosecute cases of abuse, neglect, and financial exploitation involving clients.
Qualifications:
- Juris Doctor (J.D.) degree from an accredited law school.
- Admission to the New Jersey Bar and in good standing.
- Knowledge of guardianship law, elder law, Medicaid, Social Security, and fiduciary responsibilities preferred.
- Strong research, writing, litigation, and advocacy skills.
- Ability to work collaboratively with interdisciplinary teams.
- Commitment to protecting vulnerable populations.
